Pre-Work App

Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the Pre-Work App mobile application (the “Service”) operated by Paintbrush Marketing (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

1.1 Account Creation

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

1.2 Account Security

You are responsible for:

• All activities that occur under your account
• Notifying us immediately of any unauthorized access

1.3 Account Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you must have permission from a parent or guardian.

2. Subscription Terms

2.1 Subscription Tiers

Pre-Work App offers three subscription tiers:

• Basic (Free): Free forever with limited features
• Premium: $9.99/month with advanced features
• Enterprise: $29.99/month with complete features

2.2 Free Trial (If Applicable)

We may offer a free trial period for Premium or Enterprise subscriptions. At the end of the free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

2.3 Automatic Renewal

IMPORTANT: All paid subscriptions automatically renew unless you cancel at least 24 hours before the end of the current subscription period.

• Monthly subscriptions renew every month
• Annual subscriptions (if offered) renew every year
• You will be charged through your Google Play account
• Renewal charges occur within 24 hours prior to the end of the current period

2.4 Cancellation Policy

You may cancel your subscription at any time:

• Open Google Play Store on your device
• Go to Menu → Subscriptions
• Select Pre-Work App
• Tap “Cancel Subscription”

To avoid being charged for the next period, you must cancel at least 24 hours before your renewal date.

When you cancel:

• You retain access until the end of your current billing period
• You will not be charged for subsequent periods
• Your account will downgrade to Basic (Free) tier after the period ends

2.5 Refund Policy

All subscription fees are non-refundable except as required by law or as explicitly stated below:

• Accidental purchases: Contact us within 48 hours for a refund
• Technical issues: If the Service is unavailable for more than 48 consecutive hours due to our fault, you may request a prorated refund
• Billing errors: We will promptly correct any billing errors and refund any overcharges

2.6 Price Changes

Subscription prices may change at any time. We will provide you with at least 30 days’ notice before any price increase:

• Notification will be sent via email and in-app notification
• The new price will apply to your next billing cycle after the notice period
• You may cancel your subscription before the new price takes effect
• Continuing to use the Service after the price change constitutes acceptance

2.7 Subscription Management

You can manage your subscription through:

• Google Play Store → Subscriptions
• Pre-Work App → Settings → Subscription

Note: Deleting the app does NOT cancel your subscription. You must cancel through Google Play Store.

3. Acceptable Use Policy

3.1 Permitted Use

You may use the Service for lawful purposes in accordance with these Terms.

3.2 Prohibited Activities

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service for spam or unsolicited communications
• Impersonate others or misrepresent your affiliation

6.3 Google Play Billing

All payments are processed through Google Play Billing and are subject to Google’s terms and conditions.

7. Termination

7.1 Termination by You

You may terminate your account at any time by:

• Going to Settings → Account → Delete Account

7.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you:

• Breach these Terms
• Violate applicable laws
• Engage in fraudulent activity
• Fail to pay subscription fees

7.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We will delete your account and data within 30 days (unless required to retain by law)
• You may request a data export before deletion
• Outstanding subscription fees remain due
• Provisions that should survive termination will survive (liability limitations, dispute resolution, etc.)

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results from using the Service will be accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAINTBRUSH MARKETING SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Lost profits, data, or business opportunities
• Damages resulting from your use or inability to use the Service
• Damages resulting from unauthorized access to your account

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Paintbrush Marketing, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
